Property work is won or lost before the contract is signed

A reservation payment and a polished sales pack are not legal due diligence. We act independently, check the property and seller, explain the risks and negotiate the contract before the buyer becomes committed.

New build, resale and assignment are different transactions

A new build raises developer, permit, specification, staged-payment, completion and title-creation issues. A resale turns on the existing title, physical condition, clearances and completion mechanics. An assignment adds the original contract, deposit status and assignor’s rights. Using the same checklist for all three leaves gaps.

The 2026 points buyers are still getting wrong

Cyprus stamp duty was repealed for documents signed from 1 January 2026. That does not remove VAT, Land Registry transfer fees, filing costs or other expenses. Documents signed by at least one party by 31 December 2025 can remain within the former stamp-duty regime.

The Specific Performance framework also makes the current Land Registry search certificate part of the contract pack in the cases covered by the law. That certificate is important, but it does not replace independent review of the title, permits, contract and payment route.

Questions buyers and sellers ask

Can I buy a property without a separate title deed?

Sometimes a transaction can proceed, but the risks and safeguards depend on the land, original contract, developer, mortgages, permits and ability to deposit or assign the contract. The absence of a separate title should be investigated, not dismissed as normal.

Does a reservation agreement fully protect the buyer?

Usually not. It may record price, deposit and a short exclusivity period, but it rarely contains the full title, permit, payment, default and completion protections of the sale contract. It should be reviewed before money is paid.

Does every non-EU buyer need permission to acquire property?

Many acquisitions by non-EU nationals require an application under the relevant Cyprus rules, subject to the property and purchaser. This is separate from immigration permission and separate again from the title transfer.

Why should I instruct an independent Cyprus property lawyer before paying a reservation deposit?

An independent lawyer acts for your interests, not for the seller, developer, estate agent or lender. The role is to investigate ownership, registered burdens, permits, title-deed status, contract terms, payment protections and completion risks, and to explain material issues before a deposit becomes non-refundable. Independence does not mean promising a risk-free transaction; it means giving clear advice based on the available evidence.

Can a Cyprus property purchase or sale be handled while I remain abroad?

Often, much of the legal work can be handled through online meetings, secure document exchange and a suitably limited power of attorney. Original signatures, certification, legalisation or Apostille requirements depend on where documents are signed and how they will be used. We identify any attendance requirement early and can coordinate with independent surveyors, architects, valuers, banks and overseas advisers where the matter requires them.

How long does buying or selling property in Cyprus take?

There is no dependable universal timetable. Timing can be affected by the title and search results, mortgages or other burdens, permits, contract negotiations, finance, source-of-funds review, tax clearances, reduced-VAT procedures, non-EU acquisition permission, completion documents and Land Registry availability. After reviewing the initial documents, we identify the likely stages, dependencies and matters that may delay completion.

What costs should I budget for in addition to the property price?

The budget may include VAT where applicable, Land Registry transfer or filing fees, legal fees and disbursements, searches, survey or valuation costs, financing and mortgage expenses, insurance, utilities, common expenses and immediate property work. Reduced 5% VAT is a separate application for a qualifying primary residence and should not be assumed from a sales quotation. A single percentage can be misleading because a resale, a VAT-bearing new build and an assignment can produce very different totals. Does buying property give me Cyprus residence or citizenship?

No. Property ownership, immigration residence and citizenship are separate legal processes. A property can support accommodation or form the qualifying investment under Regulation 6(2), but the applicant must satisfy the separate immigration criteria.
