
Cyprus Court of Appeal: What the Trapped Buyer Judgment Means for Property Purchasers
Can a deposited sale contract or trapped buyer application stop an auction by a prior mortgagee? A recent Cyprus Court of Appeal decision shows why the answer depends on priority, timing and the legal regime that applies to the transaction.
The decision
In Adonis Adoni v K&Y Theodorou Investments & Construction Ltd under administration and others, Civil Appeal E178/2019, decided on 9 September 2026, the Court of Appeal considered a dispute involving an older deposited contract, a trapped buyer application, prior mortgage enforcement and an auction sale.
The appeal was dismissed. The Court followed the existing appellate position on the constitutional limits of the 2015 trapped buyer provisions where prior registered mortgage rights were involved.
Why this matters to buyers
The practical risk is clear. A purchaser should not assume that an old deposited contract or trapped buyer application will automatically stop enforcement by a prior mortgagee or prevent an auction transfer.
This is particularly important where the developer is insolvent or in administration, or where the property is being sold by a bank, fund, receiver, liquidator or through an auction process.
What should be checked before you commit
The solution is a priority and enforcement chronology review. Before signing or paying a substantial amount, obtain a current Land Registry search and identify the date and ranking of every mortgage, encumbrance and deposited contract. Check any trapped buyer application, enforcement notice, auction step and transfer history.
The contract should then be structured around the actual title and enforcement position, rather than an assumption that an older purchaser protection will override a prior registered security.
An important distinction
This judgment is case law, not a new statutory amendment. It arose from the legacy trapped buyer regime and should not be treated as an automatic answer for contracts governed by later legislative amendments without separate legal analysis.
