Moving from Austria to Cyprus: Residence, Deregistration, Investments and Exit Tax
From Evi’s Desk | Evi Papacleovoulou | Cyprus Law Chambers
Updated 16 September 2026.
Moving from Austria to Cyprus requires the Cyprus residence, tax and practical workstreams to be coordinated with Austrian deregistration, residence, investment, employment and company issues. This guide provides general information; the result depends on the individual facts and current law in both countries.
What the move requires in practice
An Austrian or other EU citizen generally begins from EU free movement, but the Austria departure file should also address residential deregistration, Austrian tax residence, capital assets, GmbH shares, investment accounts, employment, pensions and any departure taxation or payment-deferral treatment available for a move to an EU or EEA state such as Cyprus.
First identify the Austrian profile
Austrian citizen moving alone or with family
Non-EU spouse or Austrian permit holder
Employee continuing with an Austrian employer
GmbH shareholder or director
Investor with securities, funds or derivatives
Owner of Austrian property
Pensioner or financially independent person
What changes because the move begins in Austria
Residential deregistration
A person giving up an Austrian residence must complete the applicable deregistration within the current short statutory period and keep the confirmation. The administrative step should match the actual date and facts of departure.
Austrian tax residence
Deregistration does not by itself settle tax residence. Retained accommodation, family, work, business functions, presence and treaty facts require Austrian review.
Capital assets and departure taxation
Austria can treat a loss or restriction of its taxing right over certain capital assets as a realisation event. Current official guidance also describes a non-assessment or deferral mechanism that may be claimed for qualifying moves by natural persons within the EU or EEA until an actual disposal. The assets, claim procedure and later events require current Austrian advice.
GmbH and management functions
A shareholder or director should review salary, dividends, signing authority, board activity, company residence and any intercompany or Cyprus structure before continuing management from Cyprus.
Illustrative relocation story
Illustrative scenario -Anna owns shares in an Austrian GmbH and a portfolio held through an Austrian bank. She plans to move to Cyprus with her partner and continue strategic work for the GmbH. The project requires Austrian deregistration, tax-residence and departure-tax advice, asset records, company governance, Cyprus residence registration, housing, payroll or consultancy analysis and first-year day tracking.
Before leaving Austria
Complete residential deregistration and retain the confirmation
Obtain Austrian advice on tax residence and treaty position
List shares, funds, derivatives and other capital assets
Review departure taxation and any non-assessment or instalment election
Clarify GmbH, employment, payroll and social-insurance treatment
Prepare family, school and civil-status documents
Arrange certifications and translations where required
Prepare banking and source-of-funds records
First 120 days in Cyprus
Before travel
Confirm each residence route, accommodation, insurance and the Austrian tax, company and employment instructions.
First 30 days
Stabilise the Cyprus address and work position, activate utilities, organise KYC, track days and begin residence and first-year tax implementation.
Residence-application deadlines
Submit the correct residence application within the deadline applicable to each person. EU registration, non-EU family applications and national immigration routes must not be treated as interchangeable. Some entry or residence requirements need attention before travel or before the permitted stay expires. Filing an application is not the same as obtaining approval, and a permit issued by the departure country does not automatically authorise residence or work in Cyprus.
First tax year
Coordinate Austrian and Cyprus returns, certificates, deferred or monitored departure taxation, salary or dividends, investments and retained property.
Frequently asked questions
Does Austrian deregistration end tax residence?
No. The tax and treaty tests depend on the complete facts.
Is Austrian exit tax always payable immediately when moving to Cyprus?
Not necessarily. Current EU/EEA treatment may allow an application for non-assessment or another payment mechanism, but the asset and procedural requirements must be checked.
Can I keep directing my Austrian GmbH?
Possibly, but corporate residence, management, payroll and personal tax consequences require coordinated advice.
Does Cyprus non-dom replace Austrian advice?
No. Cyprus non-dom and Austrian departure taxation are separate regimes.

What the relocation review should produce
A coordinated move should produce a route for each family member, the permitted activity, document and certification requirements, critical dates and the links between housing, work, company, tax, healthcare, schooling and departure-country advice.
The client should leave with a route map, evidence pack, critical-date calendar, first-year decision plan and a responsibility matrix showing which adviser owns each workstream.
